Terms of service

Last updated 22 October 2026. These terms are a contract between you and Kindnod (kindnod.com, United States; hello@kindnod.com) for the use of the Kindnod service. By creating an account or installing the Kindnod script on a site you control, you accept them.

1. The service

Kindnod provides a hosted cookie consent banner, a cookie scanner, a consent record log, and related tools for websites. Kindnod records visitor consent decisions on your behalf and makes them available in your dashboard. Kindnod is not a law firm and does not give legal advice; you remain responsible for your site's compliance, your privacy policy, and the accuracy of your cookie declaration.

2. Accounts and sites

You may only add sites you own or are authorised to manage. A site created by the keyless install belongs to whoever claims it by proving control of the domain or by the claim link sent to the owner email on the tag. You are responsible for keeping access to your email address secure, since sign-in is by email link.

3. Plans, billing, and changes

The Free plan covers one domain and is free for as long as you use it. Pro is €9 a month or €79 a year per domain. Agency is €29 a month for ten domains, with each further domain added at the published tier price and a cap of €99 a month; when you add a domain beyond those on your subscription, Kindnod increases the subscription quantity and prorates the difference on your next invoice. Prices exclude VAT and other taxes, which are added where Kindnod is required to collect them. Payments are processed by Stripe. Subscriptions renew until cancelled; you can cancel at any time from the billing page and keep the paid features until the end of the period already paid. Kindnod may change prices with 30 days' notice by email; changes apply from your next renewal.

4. Fair use

Each plan includes a monthly allowance of consent decisions, published in the docs. Above it the banner keeps working, and consent records older than 90 days are deleted until usage falls back within the allowance. Kindnod may rate-limit or suspend a site that attacks the service, scrapes it, or is used for unlawful content.

5. Data

Where Kindnod processes personal data of your visitors, the data processing agreement applies and forms part of these terms. The privacy policy describes what Kindnod collects about you and about visitors to kindnod.com. Consent records are stored in the European Union. Kindnod keeps them for the retention period of your plan and deletes them within 30 days after your account is deleted.

6. Availability and support

Kindnod aims for the banner script to be served at all times and designs it to fail open: if the Kindnod service is unreachable, the banner falls back to a default configuration that blocks non-essential scripts until consent. Support is by email at hello@kindnod.com, answered on business days.

7. Open source

The banner script and the npm package are licensed under the MIT licence and may be used under its terms independently of these terms. The hosted service, dashboard, scanner, and consent log are provided under these terms only.

8. Warranties and liability

The service is provided as is. Kindnod does not warrant that a banner configured by you satisfies any particular law, or that the scanner finds every cookie. To the extent permitted by law, Kindnod's total liability for all claims in any twelve-month period is limited to the fees you paid Kindnod in that period, and Kindnod is not liable for indirect or consequential loss, lost profits, or regulatory fines. Nothing in these terms limits liability that cannot be limited by law.

9. Termination

You can delete your account at any time from the dashboard. Kindnod may suspend or terminate an account that breaches these terms, with notice where practical. On termination the banner stops serving your configuration after a grace period of 14 days, and your data is deleted under section 5.

10. Governing law

These terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. Consumers in the European Union keep the protections of the mandatory law of their country of residence.

11. Changes to these terms

Kindnod may update these terms. Material changes are announced by email at least 30 days before they take effect. Continued use after that date is acceptance.
